Privacy Policy

This policy explains what personal information Evenhurst Advisory collects, how we use it, who we share it with, and the choices you have. We collect only what we need to respond to you and to do the work you engage us for. We do not sell personal information.

1Who we are

Evenhurst Advisory LLC, a Wyoming limited liability company (“Evenhurst,” “we,” “us”), provides buyer-side transaction advisory services, including deal reviews, quality of earnings, valuation and transaction assessments, to people and companies acquiring businesses in the United States. 2What this policy covers

This policy applies to personal information we collect through our website, our quote and enquiry forms, email, calls, online purchases, and when we provide our services. It does not apply to third-party websites we link to.

Documents and data that clients share with us for an engagement, such as a target company’s financial statements, payroll records or customer lists, are also governed by the confidentiality terms of the client’s engagement letter. Where those terms are stricter than this policy, the engagement letter controls.

Information collected automatically

When you visit our website, our hosting and security providers record standard technical data: IP address, browser and device type, pages visited, referring page and the date and time of the visit. We use Cloudflare Web Analytics, which measures visits in aggregate without cookies or cross-site tracking. We use only cookies that are strictly necessary for the site and our forms to work. We do not use advertising cookies or tracking pixels.

Information from other sources

We may receive your information from a broker, lender, attorney, accountant or other professional who refers you to us, from your own advisors at your direction, and from public sources such as professional profiles and company registries.

4How we use information

  • Respond to enquiries, prepare quotes and proposals, and schedule calls.
  • Check for conflicts of interest before accepting an engagement.
  • Perform the services you engage us for and communicate with you about them.
  • Invoice, collect payment and keep business records.
  • Protect you and us against fraud, including payment-instruction fraud, and keep our systems secure.
  • Send Deal Notes and occasional updates if you have subscribed or are a client. You can unsubscribe at any time.
  • Improve our website and services using aggregate information.
  • Comply with law, respond to lawful requests, and establish or defend legal claims.

We do not use engagement materials for marketing. Examples or case studies we publish are anonymized and do not identify a client or target company without the client’s written consent. We do not make decisions about you based solely on automated processing.

5How we share information

We do not sell personal information, and we do not share it for targeted or cross-context behavioral advertising. We share information only as follows:

  • Service providers that host and operate our business under contracts that limit their use of the data, including website hosting and security, email, calendar and document storage, e-signature, payment processing and accounting.
  • Professional advisors such as our lawyers, accountants and insurers, under duties of confidentiality.
  • At your direction, for example with your lender, investors or advisors, under the terms you agree with us.
  • For legal reasons, when required by law, subpoena or court order, or to protect the rights, safety or property of Evenhurst, our clients or others.
  • In a business transfer, such as a merger or sale of our business, subject to this policy.

6How long we keep information

When the retention period ends, we delete information or make it anonymous.

7How we protect information

We use encryption in transit, multi-factor authentication, access limited to the people working on an engagement, and a separate restricted folder for each client. We will never send or change payment instructions by email. If you receive an email asking you to send money to new account details in our name, do not act on it and call us at a number you already know. No system is completely secure, and we cannot guarantee the security of information sent to us over the internet.

8Where information is processed

Our service providers store information mainly in the United States. Our personnel may access information from other countries. We apply the same protections wherever information is accessed.

9Your choices and rights

You can ask us to:

  • confirm whether we hold your personal information and give you access to it or a copy of it;
  • correct information that is inaccurate;
  • delete your information, subject to records we must keep by law or for an active engagement;
  • stop sending you marketing emails, using the unsubscribe link or by writing to us.

Residents of states with consumer privacy laws, including California, may have additional rights, such as the right to opt out of sale, sharing or targeted advertising. We do not do these things. We honor these rights to the extent the applicable law gives them to you.

To make a request, email [email protected]. We will verify your identity before acting and respond within 45 days. An authorized agent may make a request on your behalf with proof of authority. If we decline a request, you may appeal by replying to our decision, and we will respond to the appeal in writing. We will not treat you differently for exercising your rights.

10Do Not Track and Global Privacy Control

We do not track visitors across third-party websites, so our website does not change its behavior in response to Do Not Track signals. We treat a Global Privacy Control signal as a request to opt out of sale or sharing. Because we do neither, no further action is needed.

11California notice

California residents may ask what personal information we have disclosed to third parties for their own direct marketing purposes. We do not disclose personal information for that purpose.

12Children

Our website and services are intended for adults acting in a business capacity. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us information, contact us and we will delete it.

13Changes to this policy

We may update this policy from time to time. We will post the updated version on this page with a new “Last updated” date. If we make a material change, we will also notify clients by email before the change takes effect.
